Welcome to Windigo. Windigo ("Application") is a Windows Phone application and it provides access to Diigo Bookmarks. It is created by Ash Tewari ("Author"). By using this application, you agree and acknowledge to be bound by these Terms of Use ("Terms"). If you do not agree to these terms or to the Privacy Policy, please do not use this application. The terms of use and privacy policy may be occasionally updated to reflect changes in the application and any services associated with it. This application uses Diigo application programming interface (api) but it is not endorsed or certified by Diigo Inc. Any Diigo logo and Diigo trademarks displayed in this application are the property of Diigo Inc. If you don't already have one, you will need to open a Diigo account here : http://www.diigo.com/. Any other logos and/or trademarks are the property of thier respective owners.

Warranty Disclaimer

This application is provided "as-is," "with all faults," and "as available." There is no guarantee or warranty of availability of, access to or performance of this application's functionality and the 3rd party api and services mentioned above. It is entirely your responsibility to comply with the terms of your service with Diigo Inc. Author is not be liable in any way if the availability and performance of API or services available via Diigo.com are suspended, disrupted, diminished, removed, disabled, transferred or discontinued for any reason. Any implied warranties or conditions, those of merchantability, fitness for a particular purpose, workmanlike effort, and non-infringement, are excluded. You may have additional consumer rights under your local laws that this contract cannot change.

You understand and agree that you use this Application at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. UNDER NO CIRCUMSTANCES SHALL WINDIGO OR ITS AUTHOR BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BY NEGLIGENCE), INCLUDING WITHOUT LIMITATION, DAMAGES RELATED TO USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION, SUSPENSION, OR TERMINATION OF THIS APPLICATION OR SITE, DAMAGES INCURRED THROUGH ANY LINKS PROVIDED IN THE APPLICATION OR ON THE SITE AND THE NONPERFORMANCE THEREOF AND DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT WINDIGO OR ITS AUTHOR HAS BEEN ADVISED OF SUCH POSSIBILITY. Author reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the functionality available via this application (or any part thereof) with or without notice. You agree that the Author shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Privacy Policy

This application (Windigo) may use your location information to deliver personalized content and advertisements to you. The use of location data by this application is in accordance with your terms of service agreement with Microsoft as described in the Display of Advertising section here : http://www.microsoft.com/windowsphone/en-us/privacy.aspx. You will be prompted for your consent in this matter when you first launch this application. You can change your mind about this and turn this application's use of your location information off or on at anytime using Settings page in this application.

This application uses runtime analytics software to implement the Customer Experience Improvement Program. This is to collect data for tracking this application's feature usage and error reporting. Your phone's unique device identity code is used in this context to count the number of unique users of this application. If you agreed to allow this application to use your location information, then your location information may also be used as input into this program for the above stated purposes. This application does not share or otherwise transmit any of your personal information other than as described in this document.

The Diigo username and password you provide will be stored on your phone and transmitted to Diigo.com in order to provide this service. Your password is securely encrypted and stored on your phone for your convenience. You can remove the stored username and password from the settings page in this application.This application will cache the bookmarks retrieved from Diigo.com and your browsing history in order to improve your experience while using this application. This cached data is not transmitted anywhere outside of your phone. This cached data will be removed from your phone if you uninstall this application.
